1.This document indicate the general terms and conditions of use www.CIABOOBG.com which establishes rules for the use, including the conclusion of a contract of sale with this online store.

. III.Definitions

1.Vendor– online shop for shoes Ciaboo,website ciaboobg.com

2.Website – www.CIABOOBG.com domain and its subdomains;

3.Customer– any natural or legal person or other legal entity that uses the website of the online shoe store CIABOO in any way including making purchases, return goods, etc .;

4.Account - section of the site, formed from the email address and password, which allows customers to send his purchases and that contains information about the Customer and history of some of his actions at the Site;

5.Purchase– an electronic document which representing a communication form between customer and vendor .By  this document the buyer tells the seller his intention to purchase goods and services from the Site;

6.Products– в each goods that is object of purchase contract between customer and vendor

7.Campaignany commercial communication aimed at the promotion of certain goods and / or services that are offered in limited supply, unless the commercial communication specifically stated otherwise, for a period of time specified by the Seller;

8.Contract–represent concluded from distance contract between Customer and Vendor for  sale trade of goods and/or services from the Website.The General terms of using of  Website are an integral part of the contract;

9.Contents

  • all the information on the Site, which is accessible through an Internet connection and use of a device having an Internet connection;
  • the contents of any communication from the buyer to the seller sent by electronic means and / or any other available means of communication;
  • any information provided by any means by the employee / associate of the Vendor to the Customer by electronic or other means to transfer infromation from a distance;
  • information relating to goods and / or services and / or tariffs applied by the Vendor within a specified period of time;
  • information concerning customers and related with  goods and / or services and / or applicable tariffs by third parties with whom the Vendor has concluded a partner in some form contracts;
  • information about the Ventor or other date related to him

 10.Newsletter –means of periodic information on the Seller goods, services and promotions sent electronically via e-mail

11.Transaction- the action from online shoe store CIABOO for refund the amount to the Purchaser as a result of termination or non-operation of contract of sale trade by the site which is realized only by bank transfer;

12.Specifications – all features and / or descriptions of goods and services as indicated in their description;

13.Question - Form of address to other Users / Customers / Buyers to get information on products or services of the page

14.Answer - written information is transmitted to the user / client / buyer who has put a question on the website page of a product. The answer is a explanation provided by some users / customer / buyer to another User / Customer / Buyer within a dialogue.

 IV.Purchase and creation of account

1.In the upper left side of the online shoe store are the main major categories. By selecting the appropriate category displays a list of suggested items. Each model can be viewed in detail - its parameters, additional images, colors and more. Referring to the specific product (eg "Women's shoes"), it is first necessary to select the desired size, then press the BUY button. Now you are in your customer basket.

You have two options: add more items in it by clicking "Continue Shopping" or complete the order by clicking on "Proceed to Checkout." Once you are done with correct entries, you can finalize your purchase with a click of the "Finish the order".

3.Customer undertakes and ensure that all details of the purchase, which is claimed by the completed and sent to the Vendor order, are true, complete and correct to the date of dispatch of the order.

4.Seller is entitled to refuse to execute (to cancel) by Customer Order but he has to notify the Customer about this cancelling. Cancellation of the purchase does not involve any liability or obligation of either party to the contract other and in connection with that none of them has the right to seek damages from the other for the cancellation.

5.With sending order Customer allows the Vendor to contact him in any possible way when its necessary to discuss customer's order or contract

 V. Free shipping

  1. The delivery is done by courier Speedy.
  1. Delivery of models that are available is up to one (1) business day if the order is carried out by 16:00. If the order is carried out after 16:00, the delivery period is between one (1) and 3 (three) days.
  1. In case that product you have purchased is run out of stock you may receive your purchase later in time but we will contact you to discuss the date of delivery.
  1. All shipments, regardless of the type and quantity, are sent to an address in Bulgaria free to the customer. The delivery period of ordered products begins from the time of order confirmation.
  1. At impossibility your order to be executed due to out of stock or other reasons will be notified in due course. Orders placed in the same day by one user may be sent as a package, it should be mentioned further in the box for comments.
  1. At impossibility to be executed special order due reasons beyond "COMPANY GROUP" ltd we reserve right to cancel this order.Customer will be informed as soon as possible and the amount of his order will be refunded on 100 %
  1. You may use the "Review and sample before payment" option - the client has the right to open, examine and to try ordered item before to pay. In case that he decline to receive his purchase he must pay the costs of her return.
  1. You may use the option "Free exchange." The replacement can be realized by one of the following options:

8.1 Option  1: After the client pay the ordered pair of shoes he  contacted with employee of CIABOO who will send other courier with the new pair that client want for exchange.. The customer is obliged to return the pair, which does not comply and accept the right (paid only difference in price, if any). If the second pair does not match, the subsequent replacement is done at the expense of the customer.

8.2Option 2: The customer pays pairs recorded on the warranty card model for wishing to be replaced, and sends the pair back by courier at the expense of CIABOO. Once the replacement is established, is sent right pair (you pay only the difference in price, if any). If the second pair does not match, the subsequent replacement is done at the expense of the customer.

  1. Free exchange is made only in cases where the pair has been paid.

 10.The costs of replacement that occurs after the event (after the shipment is weighed and paid) shall be done at the expense of the customer.

 11.After decline of delivery of order (due to mismatch) and then make a new order for new pair - the client pay the shipping costs for the new order.

12.The option of free exchange does not apply to models of the categories liquidation and handbags in our online store where all the costs of replacing are done at the expense of the customer

 VI. Payment

  1. Payment can be done in several ways, the most common among them is " Cash on delivery"."Cash on delivery " is a service whereby the purchase price payable to the online shoe store CIABOO, collected by our courier on behalf of CIABOO.Before the purchase is delivered to the recipient or his representative, the recipient or his representative shall pay the sum of the contract courier, they have the right to open, examine and test their ordered item, before it is paid.
  1. Beside with "Cash on delivery", Online shoe store CIABOO offers the possibility to pay electronically via debit card (Maestro, Visa, Mastercard) through ePay (Bulgarian online payment system).
  1. All prices of goods and / or services on the site are final, announced in lev (BGN) including VAT and all other statutory taxes or fees.

 VII.Refusal of goods

1.In Art. 52 para. 1 and 2 of the CPA consumers, shop the online shoe store CIABOO, have the right to give up the purchased item within 14 days of receipt, without giving reasons. Returned products must be preserved in its original form, unused and undamaged packaging. Otherwise the trader reserves the right not to grant the request of the user.

 2 .The return of products is done through a courier company in cooperation with "GROUP COMPANY" ltd - the courier company for quick delivery Speedy. To exercise the right of refuse, the consumer may use the standard refuse form.

3. The cost of returning are entirely borne by the customer and are determined by the current price list of courier company, which carries out the return. Returns are sent to the contact address indicated in these terms - Bulgaria, 2500, Kyustendil, Peter Beron str. 28.

4. To meet the deadline for withdrawal is enough to send your message on the exercise of a right of withdrawal before the deadline for withdrawal.

 5. If you withdraw from this contract, we will refund all payments we received from you without undue delay and in any event no later than 14 days from the date on which inform us of your decision to withdraw from this contract .

 6. Refund of the ammount :

6.1. Cash on delivery - Customer can send purchased product with courier to specified in item 3 address. In this position he owes the cost of courier service on the current price list of the courier company

6.2.By courier - In this case, the customer must pay the courier costs (normally up to 3 lev). The amount can be obtained in the office of the courier company every Friday of the month.

6.3. By bank transfer - in this case the customer must pay the fee for bank transfer (which usually amounts to 6 lev).

Situations giving the right to refuse ordered goods:

  • Goods supplied do not correspond to the request for purchase and this can be detected by an ordinary review;
  • The price that the Client shall pay does not correspond to the amount due;
  • In case of discrepancy between the stated purchase and deliver, which has not been possible to establish the time of delivery, the Customer may request delivered goods to be replaced by tally with his application to purchase within 24 hours of receipt ;
  • The customer has the right, without compensation, to abandon the contract within 14 days from the day following receipt of the goods. In this case, the client must return the goods in the original packaging, intact. Failing this condition online shoe store CIABOO reserves the right not to accept returned goods, and thus not pay the expenses incurred in its purchase by the Customer.

 VIII. Warranty and Returns :

 1.The warranty period on all products offered in the shoe store, is 30 days and begins from the date of receipt of the items. Online shoe store CIABOO accept complaints within the warranty period of shoes. The costs of returning the ordered items and replacing them with new ones at the expense of the CIABOO. Claims in apparent defects are brought within 3 working days after the purchase of goods, while hidden defects - at the opening, but not later than the expiry of the guarantee them. Trader reserves the right not to grant the request of the customer in case of misuse and / or deliberately create conditions for return. Returns are accepted only if the warranty card.

Returns are accepted if you default on the goods in the following cases:

  1. СъгласноЧл. 112. (1) от ЗЗП, при несъответствие на потребителската стока с договора за продажба потребителят има право да предяви рекламация, като поиска от продавача да приведе стоката в съответствие с договора за продажба. В този случай потребителят може да избира между извършване на ремонт на стоката или замяната й с нова, освен ако това е невъзможно или избраният от него начин за обезщетение е непропорционален в сравнение с другия. (2) Смята се, че даден начин за обезщетяване на потребителя е непропорционален, ако неговото използване налага разходи на продавача, които в сравнение с другия начин на обезщетяване са неразумни, като се вземат предвид: 1. стойността на потребителската стока, ако нямаше липса на несъответствие; 2. значимостта на несъответствието; 3. възможността да се предложи на потребителя друг начин на обезщетяване, който не е свързан със значителни неудобства за него. Чл. 113. (1) Когато потребителската стока не съответства на договора за продажба, продавачът е длъжен да я приведе в съответствие с договора за продажба. Съгласно ал. 2 привеждането на потребителската стока в съответствие с договора за продажба трябва да се извърши в рамките на един месец, считано от предявяването на рекламацията от потребителя. Според ал. 3, след изтичането на срока по ал. 2 потребителят има право да развали договора и да му бъде възстановена заплатената сума или да иска намаляване на цената на потребителската стока съгласно чл. 114, ал. 4. Привеждането на потребителската стока в съответствие с договора за продажба е безплатно за потребителя. Той не дължи разходи за експедиране на потребителската стока или за материали и труд, свързани с ремонта й, и не трябва да понася значителни неудобства. (5) Потребителят може да иска и обезщетение за претърпените вследствие на несъответствието вреди. Чл. 114. (1) При несъответствие на потребителската стока с договора за продажба и когато потребителят не е удовлетворен от решаването на рекламацията по чл. 113, той има право на избор между една от следните възможности:
  1. разваляне на договора и възстановяване на заплатената от него сума; 2. намаляване на цената.

Съгласно Чл. 114, ал. 2, Потребителят не може да претендира за възстановяване на заплатената сума или за намаляване цената на стоката, когато търговецът се съгласи да бъде извършена замяна на потребителската стока с нова или да се поправи стоката в рамките на един месец от предявяване на рекламацията от потребителя.

Според ал. 3 на Чл. 114, Търговецът е длъжен да удовлетвори искане за разваляне на договора и да възстанови заплатената от потребителя сума, когато след като е удовлетворил три рекламации на потребителя чрез извършване на ремонт на една и съща стока, в рамките на срока на гаранцията по чл. 115, е налице следваща поява на несъответствие на стоката с договора за продажба.

Съгласно ал. 4, Потребителят не може да претендира за разваляне на договора, ако несъответствието на потребителската стока с договора е незначително.

Според Чл. 115. (1), Потребителят може да упражни правото си по този раздел в срок до две години, считано от доставянето на потребителската стока. Според ал. 2 срокът по ал. 1 спира да тече през времето, необходимо за поправката или замяната на потребителската стока или за постигане на споразумение между продавача и потребителя за решаване на спора. Ал. 3 гласи, че упражняването на правото на потребителя по ал. 1 не е обвързано с никакъв друг срок за предявяване на иск, различен от срока по ал. 1.

  1. Съгласно ЗЗП Чл. 125. (1) Рекламацията се предявява пред търговеца или пред упълномощено от него лице. (2) Рекламацията се подава устно или писмено. (3) При предявяване на рекламация потребителят посочва предмета на рекламацията, предпочитания от него начин за удовлетворяване на рекламацията, съответно размера на претендираната сума, и адрес за контакт. (4) При подаване на рекламация потребителят задължително прилага и документите, на които се основава претенцията: 1. касова бележка или фактура; 2. протоколи, актове или други документи, установяващи несъответствието на стоката или услугата с договореното; 3. други документи, установяващи претенцията по основание и размер. Чл. 126. (1) Рекламацията на потребителска стока може да се предяви до две години от доставката на стоката, но не по-късно от два месеца от установяване на несъответствието с договореното. Рекламацията на услуги може да се предяви до 14 дни от откриване на несъответствието на услугата с договореното. (2) Срокът по ал. 1 спира да тече през времето, необходимо за поправката на потребителската стока или за постигане на споразумение между продавача и потребителя за решаване на спора. (3) Ако търговецът е предоставил търговска гаранция на стоката и срокът на гаранцията е по-дълъг от сроковете за предявяване на рекламацията по ал. 1, рекламацията може да се предяви до изтичането на срока на търговската гаранция. Чл. 127. (1) Търговецът или упълномощено от него лице са длъжни да приемат рекламацията, ако тя е предявена своевременно. (2) Търговецът е длъжен да поддържа регистър на предявените пред него и пред упълномощените от него лица рекламации. (3) При предявяване на рекламация лицата по ал. 1 задължително я описват в регистъра, като на потребителя се издава документ, съдържащ датата, номера, под който рекламацията е вписана в регистъра, вида на стоката и подпис на лицето, приело рекламацията. (4) Приемането на рекламации се извършва през цялото работно време в търговския обект, където е закупена стоката или е поръчана услугата, на адреса на управление на търговеца или на друго място, посочено от търговеца. Рекламацията може да бъде предявена и във всеки от търговските обекти на търговеца на територията на страната, в които се осъществява подобна търговска дейност като тази в обекта, откъдето е закупена стоката. Правото на избор на място за предявяване на рекламацията принадлежи изцяло на потребителя. Чл. 128. (1) Отменена (2) Когато търговецът удовлетвори рекламацията, той издава акт за това, който се съставя в два екземпляра, и предоставя задължително един екземпляр на потребителя.
  1. Независимо от търговската гаранция Продавачът отговаря за липсата на съответствие на потребителската стока с договора за продажба съгласно гаранцията по чл.112-115 от ЗЗП.

IX. Returns are not accepted in the following cases:

Are not complied with instructions for correct operation of shoes

X. Terms of use and confidentiality of personal data


All Customers' personal data that have been given to CIABOO  are kept under strict control and are 100% protected.Personal customer data are only used where necessary for them to do business and not shared with third parties. Online shoe store CIABOO reserves the right to change the prices in the shop for shoes at any time. The customer is obliged to pay the amount that was current at the date of his order. The prices of products in the online shop for shoes may differ from those commercially available

 

XI. Other terms and conditions


  1. Online shoe store CIABOO reserves the right to change the design of www.CIABOOBG.com, its content and these Terms at any time. The changes take effect at the time of their execution / publishing www.CIABOOBG.com

    XII. Disputes and complaints
